1. Acceptance of Terms
By accessing or using HashPay's settlement infrastructure, APIs, or related services, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.
2. Services
HashPay provides institutional settlement infrastructure for cross-border payments using stablecoin technology. Our services include API access, settlement execution, compliance screening, and related tools. Services are provided on an as-available basis.
3. Eligibility
Our services are available only to registered businesses and financial institutions that have completed our onboarding and compliance verification process. Individual consumer accounts are not supported.
4. Compliance Obligations
You agree to comply with all applicable laws and regulations in your jurisdiction, including anti-money laundering, sanctions, and foreign exchange regulations. You will provide accurate information for compliance screening.
5. Fees & Settlement
Fees are outlined in your service agreement. Settlement times are targets, not guarantees, and may vary based on network conditions, compliance requirements, and partner availability. FX rates are determined at the time of conversion.
6. Limitation of Liability
To the maximum extent permitted by law, HashPay's liability is limited to the fees paid for the specific transaction giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
7. Intellectual Property
HashPay's settlement architecture (Patent ET/P/2025/931), trademarks, and proprietary technology remain our exclusive property. Your use of our services does not grant any rights to our intellectual property.
8. Governing Law
These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
